Terms of Use for Videomash

Welcome to Videomash! These Terms of Use (hereafter referred to as the "Terms") govern your use of the Videomash iOS application (hereafter referred to as the "App"). By using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our App.
1. License to Use the App
1.1 Use of App: Videomash grants you a personal, non-exclusive, non-transferable, revocable license to use the App for the sole purpose of video editing and related activities in accordance with these Terms.
1.2 Restrictions: You may not:
- Modify, adapt, translate, or create derivative works based on the App;
- Reverse engineer, decompile, or disassemble the App or attempt to discover its source code;
- Use the App in any manner that could disable, overburden, damage, or impair the App's functionality or interfere with other users' use of the App;
- Use any robot, spider, or other automatic device or process to access the App for any purpose without our express written permission.
2. User Content
2.1 Content Ownership: You retain ownership of the content you create using the App. By submitting, posting, or sharing content through the App, you grant Videomash a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the App's operation and promotion.
2.2 Prohibited Content: You agree not to upload, post, or share any content that is illegal, defamatory, obscene, offensive, or violates the rights of any third party.
3. Intellectual Property Rights
3.1 App Ownership: Videomash retains all rights, title, and interest in and to the App, including all associated intellectual property rights. These Terms do not grant you any right, title, or interest in the App or its content.
3.2 Trademarks: Videomash and all related logos are trademarks owned by Videomash. You may not use these trademarks without our prior written consent.
4. Disclaimer of Warranties
4.1 The App is provided on an "as is" and "as available" basis. Videomash makes no warranties, express or implied, regarding the App's accuracy, reliability, or fitness for a particular purpose.
4.2 Videomash does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
5. Limitation of Liability
5.1 To the fullest extent permitted by applicable law, Videomash shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses resulting from your use of the App.
6. Indemnification
You agree to indemnify and hold Videomash, its affiliates, officers, directors, employees, and agents harmless from any claim or demand, including reasonable attorneys' fees, arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.
7. Termination
Videomash reserves the right to terminate or suspend your access to the App, with or without cause, and without notice. Upon termination, these Terms will terminate, and you must cease using the App.
8. Modifications to Terms
Videomash may update these Terms at any time. We will notify you of any changes by posting the updated Terms on the App. By continuing to use the App after the changes are made, you accept the revised Terms.
